Immediate Actions for the Safety of Buildings

The Limassol District Local Government Organisation, following a recent serious building collapse incident, wishes to issue a renewed public call to all building owners, as well as to the management committees of apartment buildings and other jointly owned properties, to exercise due care in relation to the condition, maintenance, structural adequacy and safety of their buildings.

It is emphasized that monitoring the condition of a building and taking the necessary measures in a timely manner for repair, protection, remediation of defects and the elimination of any dangerous condition is not a matter of choice, but a serious responsibility of those having ownership, management or operational responsibility for the building, including, where applicable, management committees in relation to the common areas and shared parts of the property.

Particular attention should be given to older buildings or to buildings showing visible signs of deterioration, such as cracking, detachment of plaster or concrete elements, exposed reinforcement, dampness, corrosion, deformation, settlement or any other indication that may suggest deterioration in their condition.

The Limassol District Local Government Organisation calls upon all owners and management committees to proceed without delay with the inspection and assessment of their buildings by suitably qualified professionals registered in the relevant Register of Members of the Cyprus Scientific and Technical Chamber (ETEK), as well as, where required, by companies registered in the Register of Study Companies of ETEK.

It is further underlined that, in every case where a building is found to present a dangerous condition, the persons responsible are under an obligation to take all necessary measures without delay in order to remove the danger, protect occupants, users and passers-by, and comply with the directions and notices issued by the competent authority.

The Limassol District Local Government Organisation makes it clear that, in cases of indifference, omission or non-compliance on the part of any owner and/or management committee in relation to a building presenting a dangerous condition, will proceed where justified and permitted by law, to take all appropriate measures, for the protection of public safety, including, among other things, prohibiting the use of and/or ordering the evacuation of the building, restricting access, and/or closing the premises, applying to the Court for the issuance of relevant orders,  imposing administrative fines and initiating criminal proceedings against any person who disregards the safety of other people, occupants, passers-by and their own safety.

Prevention, responsibility and timely intervention are of critical importance in avoiding unfortunate and potentially tragic consequences.
